The information or personal data that you provide us about yourself will be treated in accordance with the provisions of the Data Protection Policies. All the information or data that you provide us when using the Platforms must be true and correspond to reality.


  • USE OF OUR PLATFORMS

 

By using our Platforms and placing orders through it, you agree to:

 

  1. Make use of these Platforms only to make legally valid inquiries or orders.
  2. Do not make any false or fraudulent orders. If it could reasonably be considered that an order of this nature has been made, we will be authorized to cancel it and inform the relevant authorities.
  3. Provide us with your email address, postal address and/or other contact information in a truthful and exact manner. Likewise, we may use said information to contact you if necessary (see our Privacy Policy). If you do not provide us with all the information we need, we will not be able to process your order. By placing an order through our Platforms, you declare that you are over 18 years of age and have the legal capacity to enter into contracts. The information or personal data that you provide us about yourself will be treated in accordance with the provisions of the Data Protection Policies. All the information or data that you provide us when using the Platforms must be true and correspond to reality.



  •  TECHNICAL MEANS TO CORRECT ERRORS

 

In the event that you detect that an error has occurred when entering your personal data during your registration as a user of our Platforms, you can correct errors related to the personal data provided during the purchase process by contacting customer service by calling +34 639 56 19 82, or by email at atencioncliente@padova.es , as well as exercising the right of rectification in accordance with the provisions of our Privacy Policy. Our Platforms show confirmation windows in various sections of the purchase process that do not allow you to continue with the order if the data in these sections has not been provided correctly. Likewise, our Platforms offer the details of all the items that you have added to your basket during the purchase process, so that, before making the payment, you can modify the details of your order.

 

If you detect an error in your order after completing the payment process, you must immediately contact our customer service, by phone or at the aforementioned email address, to correct the error.



  • SHIPPING

 

Before formalizing the order you must select the delivery method that best suits your needs. Unless we have agreed otherwise, we will send you the order consisting of the products/s listed in each Shipping Confirmation without undue delay and no later than 30 calendar days from the date of the Order Confirmation. Keep in mind that there are circumstances derived from the personalization of the products, or unforeseen or extraordinary circumstances that may affect the delivery date. If for any reason we could not meet the delivery date, we will inform you of this circumstance and we will give you the option of going ahead with the purchase by establishing a new delivery date or canceling the order with a full refund of the price paid. Keep in mind, in any case, that, except in exceptional moments, we do not make home deliveries on Saturdays or Sundays, except in the case of the virtual gift card, which will be delivered on the date indicated by you. For the purposes of these Conditions, it will be understood that the “delivery” has occurred or that the order has been “delivered” at the moment in which you or a third party indicated by you acquire material possession of the products, which will be accredited by signing the receipt of the order at the agreed delivery address. The virtual gift card will be understood to have been delivered in accordance with the provisions of the Conditions of Use of the Gift Card and, in any case, on the date it is sent to the email address indicated by you.




  • PRODUCT AVAILABILITY

 

All orders are subject to product availability. If there are difficulties in the supply of products or if there are no items in stock, we will refund any amount that you may have paid.

 

  1. CHANGE POLICY

If you wish to exchange an item purchased in PADOVA, you have 30 days from the date of purchase or shipment of your order. Items must retain all tags and be in perfect condition.

These are the options to return your merchandise:

  • You can return your order for free at our PADOVA store (C. de serrano 46). You will only have to present the items you want to return together with the exchange ticket. (Keep in mind that if you can’t go to the store, the person you choose can do it in your place).

To make changes or returns of purchases made through our website www.padova.es, you can do so within ten (10) days after the delivery of the product (delivery date at the destination address).

You must take into account the following criteria for your product to apply for exchange or return, if you do not comply with any of the following points, your product will not be applicable for exchange and it will be returned to the initial delivery address:

  • Promotional or discounted garments have no change. These garments present any of the following conditions: repaired, remanufactured or discontinued, therefore, the legal guarantee will not be enforceable. Its sale is considered final sale.
  • The garments in the Pre-Order section (made through the website) or as Special Order (made in stores) will not have change, since they correspond to garments made on customer order.
  • The product must not be modified or altered from its original state.
  • The garment must be in good condition, clean and with its original labels.
  • The changes of the garments will always be made for the value at which they were purchased.
  • The clothes must be returned to PADOVA with all its original packaging elements with which they were sent, including bags, boxes, labels, or others.

 

For changes within Spain, the return of the product to PADOVA will be assumed by the client, and PADOVA will assume the shipment of the change in case the product meets all the aforementioned criteria and that the new product selected by the client is available.

When you deliver the product to the carrier, it must already be properly packaged and it is important that the packaging is adequate according to the nature of the product so that it cannot be affected during the transport process.

Once your package has been received at PADOVA (C. de Serrano, 46, 28001 Madrid, Spain), PADOVA will have three (3) business days to check that its status is applicable for exchange/return, process your request and respond.

Once you have requested the return of your product you can choose between the following options:

  • Change of the product by size or color: the change will be subject to the availability in the inventory. In the event that the value of the new item selected is less than that of the item to be exchanged, the balance in favor of the customer will be enabled in our system for future purchases.
  • In case you want to make an exchange for a garment of greater value, the excess must be paid by bank transfer or through a payment link on the Paypal platform, before dispatching the new garment.
  • Voucher or credit note to make a new purchase at padova.es (this voucher will be valid for one year).
  • Money refund (only applies for reasons of warranty claims or right of withdrawal).

The times for the change, discriminated for each modality, according to the PADOVA policy are:

  • Change of the product by size or color: it will be dispatched in a maximum of seven (7) business days after receiving the product in our warehouse and from this moment the same times apply as for a normal delivery.
  • Voucher or credit note to make a new purchase at padova.com.co: it will be sent to your email maximum seven (7) business days after receiving the product in our warehouse.
  • Money refund (applies only for reasons of warranty / quality claims or right of withdrawal).

  – Through transfer: Maximum thirty (30) calendar days after receiving the product in our warehouse.

  – Through reversal of payment: Maximum thirty (30) calendar days after receiving the product in our warehouse.

In the event that your product does not meet the criteria of our exchange and guarantee policy, we will inform you with an email of the reason why the change or guarantee is not applicable and the product will be returned to the initial shipping address.

RIGHT OF WITHDRAWAL

Legal right to withdraw from the purchase

Right of withdrawal

The Client has the possibility of withdrawing from his order without the need to justify his decision within a period of ten (10) calendar days from the receipt of the ordered products, taking as reference the date that appears on the carrier receipt signed by the Client. In the event that the expiration date of said ten (10) day period falls on a Saturday, Sunday or holiday, the term will be extended until the next business day.

The exercise of the right of withdrawal must be carried out through an email addressed to the form located on the page of www.padova.es through which you must indicate your intention to return the order. Likewise, it is reported that the client has a form to exercise the right of withdrawal in the help section.

The exercise by the consumer and/or user of the right of withdrawal, leads to the automatic termination and at no cost to the consumer of the contract, and therefore, the return by PADOVA of the sums paid by the consumer and user, without withholding of expenses, except in cases in which the consumer has expressly selected a delivery method other than the least expensive method of ordinary delivery, in which case the employer will not be obliged to reimburse the additional costs that derive from it.

The exercise of the right of withdrawal entails the obligation of the consumer to return the product to PADOVA, in the same conditions in which it was received, no later than 10 calendar days from the date on which he communicates his decision to withdraw from the contract. Therefore, PADOVA may withhold the refund of the amount until it has received the goods or until the consumer has presented proof of their return.

In order to exercise the right of withdrawal, the product must be returned in the same conditions in which it was received, so no refund will be made in those cases in which the product is in different conditions or has suffered some deterioration, impairment or damage.

The refund will be made by the same means of payment with which the initial payment was made, except that the consumer has expressly provided otherwise, and as long as the consumer does not incur any expenses as a result of the refund.

Common provisions

 

You will not have the right to withdraw from the contract whose object is the supply of any of the following products:

 

  • Custom items.
  • Goods sealed for hygiene reasons that have been unsealed after delivery.

 

Your right to withdraw from the contract will apply exclusively to those products that are returned in the same conditions in which you received them. No refund will be made if the product has been used beyond its mere opening, of products that are not in the same condition in which they were delivered or that have suffered any damage, so you must be careful with the product(s) while they are in your possession. Please return the item using or including all its original packaging, instructions and other accompanying documents. You can make returns at any MASSIMO DUTTI store in Spain, through a messenger/courier that we will send to your home or at one of the Correos delivery points enabled in Spain in accordance with what is described below.

 

  • Returns in PADOVA store. You can return the products to our PADOVA MADRID store at Calle Serrano 46. In this case, you must go to the store and deliver, together with the item, the electronic receipt that you will have received attached to the Shipping Confirmation, which is also kept in your account on the Platforms. You can present the electronic ticket by showing it digitally through the screen of your mobile device or taking it printed to the store.

 

  • Returns through messenger/courier. You must contact us through our return request so that we can arrange collection from your home. You must deliver the merchandise in the same package that you received it, following the instructions that you will find in the “RETURNS” section on the Platforms. Additionally, keep in mind that if you make the return through a messenger/courier organized by us, you must bear the direct cost of the return.

 

Returns of defective products

 

In cases where you consider that at the time of delivery the product does not comply with the provisions of the contract, you must contact us immediately through our contact form providing the product data as well as the damage it suffers, or by calling the cell phone number +34 639 56 19 82 where we will indicate how to proceed. You can return the product to our PADOVA Madrid Spain store, delivering it to a courier that we will send to your home, at one of the Correos delivery points enabled in Spain or by sending it to the address indicated above. We will proceed to carefully examine the returned product and we will notify you by e-mail within a reasonable period of time if the refund or replacement of the same (if applicable).

The refund or replacement of the item will be made as soon as possible and, in any case, within 14 days from the date on which we send you an email confirming that the refund or replacement of the nonconforming item is appropriate.

 

The amounts paid for those products that are returned due to a flaw or defect, when it really exists, will be fully reimbursed, including the delivery costs incurred to deliver the item and the costs that you would have incurred to return it to us. The return will be made in the same means of payment that was used to pay for the purchase, except when a gift ticket is presented for the return. In the latter case, the reimbursement will be made by means of a card or a PADOVA payment ticket. In any case, the rights recognized by current legislation are protected.


  • WARRANTY POLICY:

If you contract as a consumer and user, you have the right to corrective measures, free of charge, in case of lack of conformity of the goods. We offer you guarantees on the products that we sell through this web page, in the terms legally established for each type of product, responding, therefore, for the lack of conformity of the same that manifests itself within a period of three years from the delivery of the product.

 

It is understood that the products are in accordance with the contract provided that (i) they conform to the description made by us and possess the qualities that we have presented on the Platforms, (ii) they are suitable for the uses to which products of the same type are ordinarily intended and (iii) present the usual quality and features of a product of the same type that are reasonably expected. In this sense, if any of the products does not comply with the contract, you must notify us by following the procedure and through any of the means of communication provided for this purpose.

 

The products we sell, especially handicraft products, can often present the characteristics of the natural materials used in their manufacture. These characteristics, such as variation in veins, texture, knots and color, will not be considered defects or defects. On the opposite, it will count with your presence and appreciate it. We only select the highest quality products, but natural characteristics are unavoidable and must be accepted as part of the individual appearance of the product.

Our commercial guarantee will not affect the rights that you have recognized by current legislation.

The guarantee covers manufacturing defects, which also meet the following criteria:

The term of the guarantee is sixty (60) calendar days, counted from the day the product is delivered to the customer. The guarantee does not cover the normal deterioration of the product, misuse, or damage caused by not following the instructions for care or maintenance of the products. If the purchased item has any quality problem, and you have complied with all the indicated care and washing recommendations, and the term of the guarantee that has been offered to you is still in force, you can process the guarantee request in the following ways:

  1. Go to our store and fill out the Guarantee Request form, with the garment in optimum hygienic conditions. In order to meet your request for effectiveness of the guarantee, we will proceed in the terms and according to the established rules.
  2. Through the website: the client must notify through any of the means of contact (Attention form or via e-mail to atencionalcliente@padova.es), informing the full name and document number of the buyer, order number, document number equivalent to invoice and other information that he deems pertinent for the attention of the guarantee.
  • If the request was made at the PADOVA store, once the customer has filled out the warranty request form, their request together with the item will be sent to our collection center for review.
  • Articles will be reviewed by our responsible team, who will make the appropriate decision in accordance with the provisions of the regulations governing the matter.
  • The administrative area will respond to the guarantee request within 10 business days of its presentation, by written or telephone (This period does not include the time necessary in case the article is viable to be fixed).
  • Once an arrangement, change is authorized or it is determined that the request has been denied, you will be informed in writing (via e-mail) or by telephone, indicating the steps to follow, then the item will be returned to the store where the claim was made, and in cases of online purchases, it will be sent to your address registered in the database.

  • INDUSTRIAL AND INTELLECTUAL PROPERTY

 

You acknowledge and agree that all copyright, trademark and other industrial and intellectual property rights over the materials or content provided as part of the Platforms correspond at all times to us or to those who granted us a license for their use. You may use said material only in the manner expressly authorized by us or by those who granted us a license for its use. This will not prevent you from using the Platforms to the extent necessary to copy your order information or Contact details.

 

EVENTS OUTSIDE OUR CONTROL

We will not be responsible for any breach or delay in the fulfillment of any of the assumed obligations, when it is due to events that are beyond our reasonable control (“Cause of Force Majeure”). Causes of Force Majeure will include any act, event, lack of exercise, omission or accident that is beyond our reasonable control and, among others, the following:

  1. Strikes, lockouts or other protest measures.
  2. Civil commotion, riot, invasion, terrorist threat or attack, war (declared or not) or threat or preparations for war.
  3. Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
  4. Impossibility of using trains, ships, planes, motor transport or other means of transport, public or private.
  5. Impossibility of using public or private telecommunications systems.
  6. Acts, decrees, legislation, regulations or restrictions of any government or public authority.

 

It will be understood that the obligations will be suspended during the period in which the Cause of Force Majeure continues, and we will have an extension in the term to fulfill said obligations for a period of time equal to the duration of the Cause of Force Majeure. We will use all reasonable means to end the Force Majeure Event or to find a solution that allows us to fulfill our obligations despite the Force Majeure Event.


  • OUR RIGHT TO MODIFY THESE TERMS

 

We reserve the right to modify the Terms and Conditions. The modifications introduced will not be retroactive. If you do not agree with the modifications introduced, we recommend that you do not use our Platforms.


  • APPLICABLE LAW AND JURISDICTION

 

The use of our Platforms and the contracts for the purchase of products through them will be governed by Spanish legislation. Any controversy that arises or is related to the use of the Platforms or with said contracts will be submitted to the non-exclusive jurisdiction of the Spanish courts and tribunals. If you are contracting as a consumer, nothing in this clause will affect the rights recognized as such by current legislation.
